Privacy Notice

This Privacy Notice is entered into by Operadora Inmobiliaria Achar, S. de R.L. de C.V., Operadora Lamartine 619, S. de R.L. de C.V., Operadora Newton 119, S. de R.L. de C.V., and Operadora Campeche 428 (hereinafter collectively referred to as the “OPERATORS”), and any individual who provides personal information through printed or electronic forms supplied by the OPERATORS (hereinafter referred to as the “DATA SUBJECT”).

Each of the OPERATORS declares that it is a company duly incorporated under the laws of the United Mexican States and that its addresses are located at Río Atoyac 89, Cuauhtémoc, 06500 Mexico City, Mexico; Lamartine 619, Polanco, Polanco V Section, 11550 Mexico City, Mexico; Av. Isaac Newton 119, Polanco, Polanco V Section, 11570 Mexico City, Mexico; and Av. Cicerón 612, Polanco, Polanco II Section, 11560 Mexico City, Mexico. The Data Subject declares that all information provided is true and accurate, that they have read and understood this Privacy Notice, and that they have the legal capacity to accept its terms.

This Privacy Notice establishes the terms and conditions under which the OPERATORS collect, use, process, and protect personal data provided by clients, tenants, and guests, in accordance with the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and applicable regulations. The purpose of this notice is to safeguard the privacy and informational self-determination of individuals, regardless of the method through which their data is collected.

The OPERATORS commit to processing personal data in accordance with the principles of legality, consent, information, quality, purpose, loyalty, proportionality, and accountability. Personal data will be collected lawfully and used strictly for the purposes described herein. Sensitive personal data, if any, will be processed only for the minimum necessary period. Personal data will be deleted once it is no longer required, except when retention is necessary to comply with legal obligations under applicable commercial, fiscal, or administrative laws.

The personal data collected may include, but is not limited to, full name, address (home, work, or tax), email address, phone number, credit card information, and tax identification number (RFC). Data may also be obtained from publicly available sources or third parties where consent has been granted.

Personal data is collected and processed for purposes including managing client and guest records, providing services, handling reservations, billing and payments, customer service, communication, security monitoring, statistical analysis, complaint handling, legal processes, and overall service improvement. Video surveillance systems may be used for security purposes within the facilities, and recordings will be stored securely and accessed only by authorized personnel or authorities when required.

The OPERATORS do not sell personal data to third parties. However, data may be shared with service providers and partners under strict confidentiality agreements solely for the purpose of delivering contracted services. Such third parties are obligated to protect personal data and may not use it for any other purpose.

Personal data will be retained only for as long as necessary to fulfill the purposes outlined in this Privacy Notice and to comply with legal obligations. The OPERATORS implement administrative, technical, and physical security measures to protect personal data against unauthorized access, loss, alteration, or misuse.

The Data Subject has the right to access, rectify, cancel, or oppose the processing of their personal data (ARCO rights), as well as to limit its use or disclosure. Requests may be submitted via email to: departamento.comercial@imatsc.com. Requests must include the Data Subject’s name, proof of identity, a clear description of the request, and any supporting documentation. The OPERATORS will respond within the timeframes established by applicable law.

The OPERATORS reserve the right to modify this Privacy Notice at any time to reflect legal, regulatory, or operational changes. Updates will be published on the website.

By providing personal data voluntarily, the Data Subject grants express consent for its collection, use, and processing in accordance with this Privacy Notice. Consent may also be implied if no objection is raised within 48 hours of publication. The Data Subject may revoke consent at any time; however, certain data may be retained where required by law.

This Privacy Notice is governed by the Federal Law on Protection of Personal Data Held by Private Parties and other applicable Mexican laws. It is effective as of the date of publication.

The Data Subject expressly acknowledges having read and accepted the terms of this Privacy Notice.
